Now, the airline other passengers on the same flight to contact us for any compensation.

It was consumer law firm TRS Travel Right who noticed that the Norwegian withdraw from judicial review and now pay the complainant the family.

But the airline does not allow something wrong in itself. Norwegian still maintain that the technical error that caused the delay is not within its control. Hence, the airline does not have to pay passengers compensation.

And it is around this that there is no legal practice, according to Norwegian. The industry is now waiting for a coming judgment of the Court of Justice, the TRS is not convinced that something odd case can lead to any case law.

Norwegian disagree and says in a written comment to SvD Business matter in the EU Court is likely to be “indicative of the airline industry and in anticipation of a ruling by the European Court of Justice in combination with an assessment of how much resources and costs, we would like to add to this subject, we now choose to pay.”

TRS representing a further 59 passengers on the same flight. Norwegian thinks they should contact the company directly instead.

HH: Will they be compensated?

– We will look at this, it is possible that they receive the same amount, says Charlotte Holmbergh Jacobsson, Director of Communications at the Norwegian Sweden.
