There may be several who boast about their respective friday. Some chip manufacturers do not have exclusive rights to the term, the Market Court ruled.
Snack giant OLW was first to market its chips and cheese doodles as “friday”. But then came the upstart Fredagsmys AB and was spot on including Hemköp and Willys snack shelves with bags marked right – friday.
This got Orcla where OLW included, to turn to Marknadsomstolen, and require the prohibition of other snack manufacturers the use of the term in marketing. But the Market does not believe that OLW shown that “friday” associated with that OLW snacks. Therefore Fredagsmys AB is not guilty of passing off, writes Dagens Media.
