Vaxjo get right on district heating – Västerbotten Courier

The Competition Authority withdraws its appeal in the high-profile target of district heating in Växjö, reports local media. Last winter hit Stockholm District Court held that the municipality had the law on their side when homeowners were forced to join the district. Then appealed the Competition Authority to the Market and the highest court granted leave to appeal.

But now thus Competition Authority decided not to pursue the case further.

– It is because it has been no convictions in the Market. We have done an analysis of the judges and seen what the courts require, and assessed that the major effects needed to announce a ban is not in Vaxjo case, says Magnus Jonson, deputy director of the Competition Authority’s legal department, to Smålandsposten.

the District Court noted in its judgment that there is no basis for concluding that the municipality’s procedure would lead to competitive harm on the market for sale of the land.
